K1 Visa Requirements

To enter the U.S. through marriage, one needs a K1 Visa. As there are various K1 Visa requirements, it is essential to know the basic laws pertaining to the K1 Visa process and K1 Visas in general.
The K1 Visa processing takes about 120 days. Only after the marriage takes place, can the foreign citizen can apply for the Green Card visa. This visa gives them a permanent citizenship status as per U.S. visa requirements. The foreign citizen can thus migrate to the U.S. with the help of the K1 Visa but it should comply with the laws of both the countries.
The K1 Visas (also known as K1 Fiance Visas) are given to those who wish to marry U.S. citizens. The couple must marry within a 90 day time frame. After the marriage takes place, the foreign citizen can apply for a Green Card to become a permanent citizen. They can then enjoy the rights of the citizens except for the right to vote, which they get after 5 years.
To obtain a K1 Visa, there are certain U.S. visa requirements that have to be met. The petitioner who applies for the Fiance Visa must be a permanent member of the U.S. Also, Green Card holders cannot apply for the K1 Fiance Visa. Both persons must be legally entitled to marry as per the rules of both the countries. If previously married, he/she must be divorced or widowed. It is mandatory that they must also have met 2 years prior to the filing of the K1 Visa. The petitioner must also have a minimum income requirement that is above the poverty level set by the Congress every year. The foreign fiancee must not have any criminal record. Finally, he/she must pass the medical exam at a clinic approved by the U.S. consulate.
Once the petition is made to the INS, it approves and forwards to the appropriate U.S. embassy. The embassy then conducts the final interview.

There are many immigration problems in the US. With more Thai fiancee flying to the US and not returning rules and regulations are becoming very strict espeically for a K1 visa and a K3 visa.
Getting married to a Thai creates much paperwork. Having to get a mountain of paperwork done in a country that you do not speak the language makes it even more difficult. Obtaining the K1 Visa or a K3 Visa is another mountain on its own. They come with many requirements and depending on where and how it is started K1 Visa and K3 Visa times vary.
You can either apply for a fiancee visa (K1 Visa) or a spouse visa (K3 Visa) for your Thai bride, but you still have to comply with several requirements. There are many specialized lawyers that can help you with this. The law requires that you and your Thai fiancee must have been legally free to marry and if your Thai fiancee is granted a K1 Visa, you have to marry her within 90 days after arrival in your own country for the K1 visa..
You may need to show documents to prove your relationship with your Thai fiancee for your K1 Visa so keep track of those emails you exchanged with each other, letters, photos, plane tickets and any other proof that you have a relationship going on. To obtain a K3 visa for your Thai bride, first of all you must get married so you can petition your Thai wife to migrate to your country. If you get married in Thailand, you must comply with all the requirements of applying a marriage certificate and getting married whether in the temple or civil ceremony. This is where the K3 visa starts.
You must not forget to bring important documents if you want to get married in Thailand, such as your US passport, an Affidavit from the US Embassy, a divorce decree or spouse’s death certificate if you were previously married, proof that you have informed your parents if you are 22 to 24, or proof of parental consent if you are 18 to 21 years old. These are needed in filing for a marriage license. Your marriage must be authentic and valid under Thai law, and only then can you file a petition to get a visa for your Thai wife.
Here is a brief run on the procedures of acquiring a K3 Visa. After you return to your own country, you should file a petition with the nearest office of the Immigration and Naturalization Service (INS) where your place of residence is covered. The INS will in turn send the papers to your Thai bride for her to comply. You and your Thai bride must return all required forms to the National Visa Center, who will in turn forward all of the documents to the US Embassy, including your Affidavit of Support.
Your Thai wife will then have to wait for an interview with the consular officer in your Embassy who will determine if she will be issued a visa or not. Your Thai fiancee will always need help in Thailand with the K1 Visa and the K1 Visa procedures. Alternatively the K3 Visa or K3 Visa regulations. There are a need for certain documents:
Proof of Having Met your fiancee in the past 2 years:
Copies of all airline boarding passes, train passes, itineraries, hotel receipts, passport stamps (make sure you can read the dates on the stamps)
Color Photo’s of you and your fiance(e) together. Make sure you write your names, date, and location on the back of every photo. Provide two to five photo’s
Sometime you can add more documents to boost the application such as copies of phone bills, cell phone bills, email etc
